Refund & Cancellation Policy

Important Notice: SALUFA operates as a marketplace that connects buyers and sellers of livestock. Refund and cancellation outcomes differ materially depending on whether a transaction was completed via online escrow (TradeSafe) or via an in-person cash arrangement. Users are advised to read all applicable sections carefully.

1. Online Payments โ€” TradeSafe Escrow

All online transactions on SALUFA are processed through TradeSafe, a licensed South African escrow platform. Funds are held securely in escrow and are only released to the seller once the buyer confirms receipt of the livestock.

Payment Method Tiers: Online escrow is available for transactions of R 200 and above. For purchases above R 10,000, online escrow is the only available payment method โ€” cash is not offered for high-value transactions, to ensure buyer protection. For transactions between R 200 and R 10,000, the buyer may choose between online escrow and Cash on Inspection.

Escrow Fee: The TradeSafe escrow fee is paid by the buyer on top of the listing price. The seller's payout is the listing price minus the 5% SALUFA platform fee. If a transaction is cancelled before delivery and funds are returned to the buyer, the escrow fee is refunded by TradeSafe in accordance with their Terms of Service.

Two sets of terms apply: Every online transaction on SALUFA is governed by both SALUFA's Refund & Cancellation Policy (this document) and TradeSafe's own Terms of Service. SALUFA's policy determines the marketplace-level rules for when a buyer may request a refund and how disputes are administered. TradeSafe's Terms govern the financial escrow mechanics โ€” how funds are held, inspected, released, and refunded. By completing an online payment on SALUFA, buyers and sellers agree to be bound by TradeSafe's Terms of Service, available at tradesafe.co.za/terms. In the event of a conflict between SALUFA's policy and TradeSafe's Terms regarding the handling of escrow funds, TradeSafe's Terms shall prevail in respect of the financial mechanics.

Cancellation Prior to Delivery: Where a seller has not yet marked the livestock as delivered, a buyer may contact the SALUFA support team to request cancellation. Upon approval, TradeSafe will return the funds to the buyer's original payment method. Processing typically takes 3โ€“5 business days.

Dispute Following Delivery: Buyers are required to inspect livestock at handover before confirming receipt. Condition-based complaints (health, appearance, weight, breed characteristics) are not valid grounds for a dispute after receipt confirmation. Valid dispute categories are limited to "Seller did not deliver livestock" (paid but no handover occurred) or "Other issue" (admin reviews case-by-case). Disputes must be raised before confirming receipt.

Auto-Confirmation: If the buyer neither confirms receipt nor raises a dispute before the confirmation deadline, funds are automatically and irrevocably released to the seller. Users are strongly advised to act within the confirmation window.

Important: Always conduct a thorough inspection of the livestock before confirming receipt. Confirmation of receipt constitutes final acceptance of the transaction. Condition-based disputes will not be accepted after confirmation.

2. Refund Outcomes for Online Disputes

Upon submission of a dispute, the SALUFA administrative team reviews evidence submitted by both parties and may issue one of the following determinations:

  • Full Refund to Buyer: TradeSafe cancels the transaction and returns all funds to the buyer. A strike is recorded against the seller's account.
  • Full Release to Seller: Evidence supports the seller's position; funds are released to the seller in full.
  • Partial Refund: Due to TradeSafe's escrow structure, which operates on an all-or-nothing basis, the full amount is first released to the seller via TradeSafe. SALUFA's administrative team then coordinates a manual bank transfer to the buyer for the agreed partial amount. All such arrangements are recorded in the platform's administrative records.
  • No Action: Where insufficient evidence is provided by either party, the original transaction outcome stands.
Administrative decisions are final within the scope of the SALUFA platform. Users who disagree with an outcome may seek independent legal advice. SALUFA is not in a position to override TradeSafe's financial processes once funds have been released from escrow.

2.1 Stolen Livestock Reports (No Time Limit)

A separate "Report Stolen Livestock" flow is available on every purchase and is not bound by the 48-hour dispute window. If a buyer discovers at any time โ€” even weeks or months after the transaction โ€” that the livestock was stolen, they may submit a stolen livestock report. These reports trigger an immediate investigation, may result in the seller's account being frozen, and will be referred to the South African Police Service (SAPS) where appropriate. False reports are treated as a serious violation and may result in account suspension.

3. Cash Transactions โ€” In-Person Inspection Sales

For cash-on-inspection transactions, payment is made directly between the buyer and seller at the point of inspection. SALUFA does not hold, facilitate, or process any cash payments. Buyers are required to inspect livestock before making any cash payment. Condition-based complaints (health, appearance, weight) are not accepted as valid disputes after cash payment. As a result:

  • SALUFA is unable to process, guarantee, or enforce refunds for cash transactions
  • Valid dispute categories for cash sales are limited to "Seller did not deliver livestock" and "Other issue" (admin reviews case-by-case)
  • SALUFA may facilitate mediation and may issue a formal warning or strike against the seller, but cannot recover funds on the buyer's behalf
  • Stolen livestock reports can be submitted at any time with no time limit, and will be referred to SAPS where appropriate
  • Where fraud is suspected, SALUFA will cooperate fully with any investigation conducted by the South African Police Service (SAPS)
Important: Buyers are strongly advised to conduct a thorough inspection of all livestock prior to making any cash payment. Once payment has been exchanged, SALUFA's capacity to intervene is limited. Condition-based complaints after payment will not be accepted.

4. Cancellation of Cash Reservations

Cash reservations on SALUFA are valid for a period of 24 hours and will expire automatically if not completed within that window. Should either party wish to cancel an active reservation prior to expiry:

  • Buyers: Navigate to My Purchases and cancel the reservation. The reserved stock will be released immediately upon cancellation.
  • Sellers: The reservation will expire automatically after 24 hours if the buyer does not complete the transaction.

No financial penalty is imposed on either party as a result of a cancelled or expired cash reservation.

5. Seller-Initiated Cancellations

Sellers may not unilaterally cancel a confirmed online escrow transaction without the buyer's express agreement. Any such cancellation, if actioned after payment has been processed, may result in a formal strike against the seller's account and an admin-initiated refund to the buyer via TradeSafe.

6. Raising a Dispute

To submit a dispute, navigate to My Purchases โ†’ Report Issue within the platform. Valid dispute categories are limited to "Seller did not deliver livestock" (paid but no handover occurred) and "Other issue" (admin reviews case-by-case). Condition-based complaints after payment confirmation are not accepted. Buyers are encouraged to provide as much detail and photographic evidence as possible to support their submission. The SALUFA administrative team aims to resolve disputes within 2โ€“5 business days of submission.

Stolen Livestock Reports: To report suspected stolen livestock, use the "Report Stolen Livestock" button on any purchase in My Purchases. This report has no time limit and triggers an immediate investigation.

7. Limitation of SALUFA's Liability

SALUFA, operated by Amaqhawe SA Technologies (Pty) Ltd (trading as AMQ Digital), is a marketplace intermediary and is not a party to any transaction between buyers and sellers. The following limitations apply to all transactions conducted on the platform:

  • No custody of funds: For online transactions, all buyer payments are held exclusively by TradeSafe. SALUFA does not hold, receive, or control buyer funds. For cash transactions, payment occurs directly between buyer and seller
  • Refunds limited to escrow: SALUFA's ability to effect a refund is limited to instructing TradeSafe to release funds held in escrow at the time a dispute is raised. Where funds have already been released to the seller, SALUFA cannot recover or refund those funds on the buyer's behalf
  • Not responsible for seller conduct: SALUFA is not responsible for the actions, omissions, or conduct of sellers, including failure to deliver livestock after payment has been made
  • Maximum liability capped: The total aggregate liability of SALUFA arising out of any single transaction shall not exceed the platform fee collected by SALUFA in respect of that transaction
  • Best-endeavours dispute resolution: SALUFA's dispute resolution process is an administrative review, not a guarantee of financial recovery. Where escrow funds have been released or the transaction was conducted in cash, SALUFA's remedies are limited to strikes, account suspension, and SAPS referral
Key point: If a seller fails to deliver livestock after an online payment, SALUFA can instruct TradeSafe to refund the buyer only if the funds are still held in escrow. If the buyer missed the confirmation window and funds were auto-released, or if the transaction was conducted in cash, SALUFA cannot recover the funds. In such cases, SALUFA will issue strikes against the seller, suspend or terminate their account, and refer the matter to SAPS where appropriate.

This policy supplements the Terms of Service and Buyer Protection Policy.
