Intellectual Property Policy

SALUFA, operated by Amaqhawe SA Technologies (Pty) Ltd (trading as AMQ Digital), respects all intellectual property rights and requires all users of the platform to do the same. This policy outlines the rules governing intellectual property on the SALUFA platform and the procedures applicable to infringement claims.

1. SALUFA's Intellectual Property

All intellectual property owned by or licensed to SALUFA โ€” including, without limitation, the SALUFA name, logo, brand identity, platform design, application code, marketing materials, and documentation โ€” is protected under the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, and applicable international intellectual property conventions.

Without prior written authorisation from Amaqhawe SA Technologies (Pty) Ltd (trading as AMQ Digital), users may not:

  • Copy, reproduce, or redistribute the SALUFA name, logo, or any brand assets
  • Reverse engineer, decompile, or attempt to extract source code from the SALUFA platform
  • Use SALUFA's trademarks or brand identity in any manner that implies endorsement, affiliation, or sponsorship

2. User-Generated Content and Ownership

Users retain full ownership of all photographs, descriptions, and other original content they create and submit to SALUFA. By submitting content to the platform, you grant SALUFA a non-exclusive, royalty-free, worldwide licence to display, store, and reproduce that content for the purposes of platform operation and SALUFA's promotional activities.

By submitting content, you warrant that it is either your own original creation or that you hold the legal right to use and distribute it on the platform, and that doing so does not infringe the rights of any third party.

3. Prohibited Intellectual Property Infringements by Users

Users are prohibited from posting content that infringes the intellectual property rights of any third party. This includes, but is not limited to:

  • Copyright infringement: Reproducing photographs, images, or text from another seller's listing, website, or any publication without authorisation
  • Trademark misuse: Using registered breed association names, stud book references, or certification marks in a misleading or unauthorised manner (e.g., falsely representing animals as "SA Studbook registered")
  • Fraudulent certification: Presenting counterfeit, altered, or otherwise falsified health certificates, vaccination records, or breed registration documents
  • Plagiarism: Reproducing listing descriptions verbatim from other sellers or external sources without permission

4. Reporting an Intellectual Property Infringement

If you believe that content published on SALUFA infringes your intellectual property rights, please contact Amaqhawe SA Technologies (Pty) Ltd (trading as AMQ Digital) at privacy@amqdigital.com or via the in-app Help Center. Your submission must include the following:

  • Your full name and contact details
  • A description of the intellectual property you own and a clear explanation of how it is being infringed
  • The specific listing URL or content identifier on the SALUFA platform
  • A statement confirming that your claim is made in good faith
  • A statement confirming that the information provided is accurate and that you are the rights holder, or are duly authorised to act on the rights holder's behalf

SALUFA will investigate all valid infringement claims and will remove or restrict access to infringing content where the claim is substantiated. Repeat infringers will have their accounts permanently terminated.

5. Counter-Notification

If your content has been removed and you believe such removal was made in error, you may submit a counter-notification to the SALUFA support team via the Help Center. The administrative team will review your submission and, where the original complaint is found to be invalid or unsubstantiated, the content will be restored.

6. Platform Liability

SALUFA operates as a marketplace platform and is not in a position to pre-screen all user-generated content for intellectual property compliance prior to publication. However, SALUFA acts promptly upon receipt of valid and substantiated infringement reports. Amaqhawe SA Technologies (Pty) Ltd (trading as AMQ Digital) and the SALUFA platform accept no liability for intellectual property infringements committed by users of the platform.

7. Governing Legislation

This policy is governed by and interpreted in accordance with the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, and all other applicable South African intellectual property legislation.
